General provisions
These terms set out the rules for using the theonebly.com website. The website is run by the THEONEBLY team (“we,” “us,” or “our”).
By using the website, you agree to these terms. If you do not agree with them, please do not use the website.
How we process personal data is described in the Privacy Policy, which is an integral part of these terms.
Using the website
The website describes THEONEBLY’s services — website development, design, SEO, advertising, and AI integrations — and lets you submit a request. By using it, you agree:
- to provide truthful information in the forms — your own or information you have the right to share;
- not to send spam, advertising, or malicious files or links;
- not to attempt to hack the website, gain access to its admin area, or overload it with automated requests;
- not to collect website materials by automated means (parsing, scraping) without our written consent;
- not to use the website for actions that violate the laws of Ukraine or the rights of others.
We may restrict access to the website or the forms for anyone who violates these rules.
Intellectual property
All website materials — texts, design, the THEONEBLY name and logo, illustrations, photos, videos, animations, software code, and case study descriptions and images — belong to us or are used with the permission of the rights holders, and are protected by copyright law.
Any copying of the materials is permitted only with the approval of the rights holders. Without written permission, you may not reproduce, modify, or distribute the website materials or use them for commercial purposes. You may quote short excerpts to the extent permitted by law, with a link to the website.
We created the projects in the “Case studies” section for our clients; the rights to them belong to us or to our clients under the relevant contracts. Names and trademarks of other companies mentioned on the website belong to their respective owners.
Prices on the website are not an offer
Prices on the website (including “from …” prices in the pricing plans), the approximate budget in the request form calculator, and the timelines and scope of work are for information only and do not constitute a public offer within the meaning of Article 641 of the Civil Code of Ukraine.
We agree on the final cost, timeline, and scope of work with you individually and set them out in the commercial proposal and the contract. A submitted request is not a contract and does not commit you to anything.
The figures in case studies and reviews show the results of specific projects. The result for your business depends on the market, the product, the budget, and other factors, so we set out guarantees and expected metrics only in the contract.
Links to other websites
The website contains links to third-party resources — social networks, messaging apps, and Google and Meta services. We do not control these resources and are not responsible for their content, operation, or data processing rules. When you follow such links, you use those resources on their own terms.
Limitation of liability
We take care to keep the information on the website accurate and up to date, but we do not guarantee that it is free of errors, and we may change it without notice.
The website is provided “as is.” Access to it may be temporarily interrupted by maintenance, hardware or network failures, or other circumstances beyond our control.
To the extent permitted by law, we are not liable for losses caused by using the website or being unable to use it, or for decisions made solely on the basis of information from the website. Our liability to clients for the services provided is determined by the contract.
Changes to these terms
We may change these terms and the website itself. The new version takes effect when it is published on this page; its date is shown at the top. If you continue to use the website after the changes, this means that you accept them.
Governing law and disputes
These terms are governed by the laws of Ukraine. We first try to resolve disputes through negotiation — write to us, and we will respond. If we cannot reach an agreement, the dispute will be heard by a court in accordance with the laws of Ukraine.
These terms do not limit the rights granted to you by the mandatory laws of your country of residence, including consumer protection laws.
